Terms & Conditions of Use, Auction & Sale

Welcome to FirearmLand.com (“FirearmLand,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “Buyer”) and MCM Retail Group, Inc. d/b/a FirearmLand governing (a) your access to and use of the FirearmLand website, mobile site, application, APIs, and any associated services (collectively, the “Site”) and (b) the bidding on, purchase, sale, transfer, shipping, use, and ownership of all firearms, ammunition, and related products (“Products”) offered via the Site. BY CREATING AN ACCOUNT, BROWSING, PLACING A BID, MAKING A PURCHASE, OR OTHERWISE USING THE SITE, YOU REPRESENT THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE TERMS AND ALL POLICIES INCORPORATED BY REFERENCE (COLLECTIVELY, THE “AGREEMENT”). IF YOU DO NOT ACCEPT ALL TERMS, DO NOT USE THE SITE.
1. Eligibility & User Representations
  • 1. You are a natural person of at least 18 years of age for long-gun purchases and at least 21 years of age for handgun or receiver purchases.
  • 2. You are a current resident of, and physically located within, the 50 United States or the District of Columbia and are not a resident of any U.S. territory, foreign country, embargoed nation, or sanctioned jurisdiction.
  • 3. You are not prohibited by federal, state, or local law from purchasing, possessing, receiving, or owning firearms or ammunition, including but not limited to restrictions under 18 U.S.C. §922(g), the Gun Control Act, the National Firearms Act (“NFA”), International Traffic in Arms Regulations (“ITAR”), Export Administration Regulations (“EAR”), or any applicable red-flag / extreme-risk laws.
  • 4. You have never been convicted of a felony or any offense that would bar you from firearm ownership, are not currently under indictment, restraining order, or subject to any mental-health or domestic-violence prohibition.
  • 5. You will provide truthful, accurate, current, and complete information at registration and maintain the security of your username, password, and account credentials.
  • 6. You acknowledge that FirearmLand does not sell outside the United States and prohibits any export of Products without prior written permission and full regulatory compliance.
2. Account Registration & Security
To bid or purchase, you must create an account and complete identity verification (which may include age verification, driver’s-license upload, credit-card validation, and/or FFL confirmation). You are responsible for all activities occurring under your account. You must immediately notify us at [email protected] of any unauthorized access or suspected breach. We may suspend or terminate accounts (a) that violate these Terms, (b) that remain inactive for 12 months, or (c) to protect Site integrity.
3. Prohibited Conduct
  • 1. Scraping, Crawling, or Automation: You may not scrape, spider, crawl, harvest, or use any robot, bot, or automated means to access, copy, or monitor any part of the Site without our prior written consent.
  • 2. Data Mining & Reverse Engineering: Decompiling, disassembling, or otherwise attempting to derive source code or algorithms is strictly prohibited.
  • 3. Interference & Disruption: You may not interfere with the proper functioning of the Site, including denial-of-service attacks, network sniffing, or transmitting any viruses or malicious code.
  • 4. Fraud & Misrepresentation: Misleading bids, shill bidding, or false claims regarding legal eligibility are grounds for immediate account termination and potential civil/criminal liability.
  • 5. Export & Diversion: Products may not be exported, re-exported, or transferred to any foreign person or country without full compliance with U.S. law and FirearmLand’s written approval.
4. Auction, Bidding & Purchase Process
  • 1. Bids are Binding. Once placed, a bid constitutes a binding offer to buy at the bid amount plus all applicable fees, taxes, and shipping.
  • 2. Closing & Payment. Payment in full is due withinseven (7) calendar days of auction close or fixed-price purchase. Use the secure FirearmLand checkout to select payment. Acceptable methods:
  • 3. Make checks payable to MCM Retail Group. Checks made to “FirearmLand” will be returned.

    • • Cashier’s, certified, or personal check (allow five business days to clear)
  • 4. Communication. If paying by mailed instrument, notify us at [email protected] within three (3) days with tracking. Failure to initiate checkout or communicate within three days may result in relisting and a 15% restocking fee.
  • 5. Non-Paying Buyers. Unpaid orders after seven days constitute breach. Buyer authorizes FirearmLand to assess a 15% restocking fee, charge any card on file, and/or seek collection.
5. FFL & NFA Transfers
  • 1. Standard Firearms. You must designate a valid Federal Firearms Licensee (“FFL”) willing to accept transfer. Your FFL must email their license to [email protected]. We ship only to U.S.-based FFLs.
  • 2. NFA ItemsNFA Items. Your receiving FFL must hold a current Class 3 Special Occupational Tax (“SOT”). After payment we file ATF Form 3; upon approval (1–2 weeks on average) we ship to your SOT. You then file ATF Form 4. All NFA rules apply.
  • 3. Magazine Restrictions. If your jurisdiction restricts magazine capacity, you must instruct us immediately upon winning. We can remove—but not replace—restricted magazines. Failure to give timely notice may result in shipment of a restricted magazine and will not be considered our error.
6. Shipping & Handling
  • • Long guns: $39.99 each
  • • HandgunsHandguns: $29.99 each
  • • Other items: $19.99 each
  • • Alaska & Hawaii: Select the correct upgraded shipping option; additional carrier costs apply.
  • • Puerto Rico, Guam, U.S. Territories: We do not ship to these locations. Orders will be cancelled and may incur restocking fees.
  • • Ammunition: Cannot be shipped to Alaska, Hawaii, or any non-contiguous U.S. region.
7. Sales & Use Tax
FirearmLand is required by law to collect and remit sales tax in states where marketplace or economic-nexus legislation applies. The tax rate displayed during checkout is an estimate; the final amount charged will be the legally mandated rate at the shipping destination.
8. Returns, Cancellations & Inspection Period
  • 1. Three-Day Inspection. From delivery to the FFL, Buyer has three (3) days to inspect for accuracy of description. Contact [email protected] before initiating any return.
  • 2. Defective or Mis-Described Items. If we materially mis-described the item, we will, at our option, repair, replace, or refund the purchase price and shipping.
  • 3. Buyer-Initiated Returns. Returns for any reason other than 8.2 (e.g., inability to take possession, buyer’s remorse) are subject to a 25% restocking fee. Shipping is non-refundable.
  • 4. Order Cancellation. Prior to shipment, FirearmLand may approve cancellation subject to a 15% fee. After shipment, the return policy in Section 8 applies.
9. State & Local Compliance
Buyer is solely responsible for knowing and obeying all laws applicable to the ownership, transport, and use of Products in Buyer’s location. FirearmLand makes no representation that a Product is legal in any specific jurisdiction; listings may contain state-specific disclaimers, but absence of a disclaimer does not imply legality.
10. Intellectual Property
  • 1. All content on the Site—text, graphics, images, logos, audio, video, software, and compilations—is owned by or licensed to FirearmLand and protected by U.S. and international copyright, trademark, and other intellectual-property laws.
  • 2. No content may be copied, reproduced, transmitted, modified, distributed, or otherwise exploited without our express written permission. Unauthorized use will result in pursuit of liquidated damages of no less than \$5,000 per violationor the maximum allowable by law, whichever is greater, plus attorneys’ fees.
  • 3. DMCA. If you believe material on the Site infringes your copyright, send a notice compliant with 17 U.S.C. §512 to our DMCA Agent at [email protected].
11. Privacy
Our Privacy Policy explains how we collect, use, and share your information and is incorporated by reference into these Terms.
12. Disclaimers & Assumption of Risk
  • 1. All Products are sold “AS IS” AND “WITH ALL FAULTS.” We conduct a visual inspection only; we do not test-fire firearms nor pressure-test ammunition.
  • 2. Buyer agrees to have every firearm inspected by a qualified gunsmith prior to use and assumes all risks (including serious injury, death, or property damage) arising from use or misuse.
  • 3. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FIREARMLAND, ITS OWNERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOST PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE) ARISING FROM OR RELATED TO THE PRODUCTS, THE SITE, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY BUYER FOR THE PRODUCT GIVING RISE TO THE CLAIM.
14. Indemnification
You agree to defend, indemnify, and hold harmless FirearmLand and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use or misuse of the Site or any Product; (b) your breach of any provision of these Terms; (c) your violation of any law or the rights of any third party.
15. Dispute Resolution, Governing Law & Venue
  • 1. These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules.
  • 2. Forum Selection. You consent to exclusive jurisdiction of the state and federal courts in New Castle County, Delaware for any dispute not subject to arbitration.
  • 3. Optional Arbitration. At FirearmLand’s sole discretion, any dispute may be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Either party may elect arbitration by providing written notice. Judgment on the award may be entered in any court of competent jurisdiction.
16. Modification of Terms & Site
We may modify these Terms or any feature of the Site at any time in our sole discretion. Changes take effect when posted, unless a later date is stated. Continued use after the effective date constitutes acceptance.
17. Severability & Waiver
If any provision is held invalid or unenforceable, that provision will be severed and the remaining provisions remain in effect. Our failure to enforce any right or provision is not a waiver of future enforcement.
18. Entire Agreement
These Terms, together with policies referenced herein (Privacy Policy, DMCA Policy, etc.), constitute the entire agreement between you and FirearmLand and replace all prior or contemporaneous understandings, whether oral or written.
